• You acknowledge that you do not own the underlying AI technology or intellectual property that makes up the PhotoArtify service, and you agree to respect the intellectual property rights of photoartify.com and any third parties.
• While you retain ownership of your generated images and custom prompts, the core PhotoArtify platform and AI models remain the property of photoartify.com.
• You grant PhotoArtify a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, and display your generated images solely for the purpose of providing the service. We do not use your content for AI model training.
• You agree that you will not use the generated images for any purpose that violates the rights of third parties, including but not limited to copyright, trademark, or privacy rights.

2.3 Prohibited Activities

You agree not to engage in any of the following prohibited activities while using PhotoArtify:

• Generating or distributing content that is illegal, obscene, defamatory, or infringing on third-party rights
• Using the service to generate content that violates copyright, trademark, or other intellectual property rights
• Attempting to reverse-engineer or extract AI models from the service
• Using the service for any commercial purpose without a valid commercial license
• Interfering with or disrupting the security or performance of the service
• Using the service for any illegal or unauthorized purpose
• Attempting to bypass any security features of the service
• Generating or distributing content that is sexually explicit, pornographic, or contains nudity (NSFW)
• Generating or distributing content that depicts violence, gore, or bodily harm
• Generating or distributing content that promotes illegal drugs, substances, or drug use
• Generating or distributing content that promotes gambling or betting activities
• Generating or distributing content that depicts minors in inappropriate contexts

4. Pricing and Payments

• All pricing is based on the AI image generation and processing services used. Pricing is subject to change with notice to users.

• Credits for AI image generation are non-refundable after they are purchased, except as specified in the Refund Policy.

5. Refund Policy

We offer the following refund options to ensure your satisfaction:

1. Full Refund: You may request a full refund within 7 days of your initial purchase if no credits have been used.
2. Partial Refund: You may request a refund for unused credits at any time. Refunds will be calculated based on the proportion of unused credits to total credits in your purchase.
3. Service Failure Refund: If our service fails to generate images as described, you may request a refund for that specific transaction within 24 hours of the service failure.

All refund requests will be processed within 14 business days. Refunds will be issued to the original payment method when possible.

6. Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.
